- Circumventing security or authentication measures
- Port scanning or vulnerability testing without permission
- Reselling services without authorization

Money-Back Guarantee
We offer a 7-day money-back guarantee for first-time customers on monthly plans. To qualify for a refund, you must request it within 7 days of your initial purchase and have used less than 10GB of bandwidth. Refunds are not available for:
- Renewals or subsequent billing periods
- Custom or enterprise plans
- Accounts terminated for Terms violations
- Services purchased during promotional periods (unless stated)
- Cryptocurrency payments (due to irreversible nature)
To request a refund, contact contact@gotoproxy.com with your account details and reason for cancellation. Approved refunds are processed within 5-10 business days to the original payment method.
7. Intellectual Property Rights
All content, features, and functionality of GoToProxy services, including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof, are the exclusive property of GoToProxy Technologies Inc. and are protected by United States and international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our services for your internal business or personal purposes in accordance with these Terms. This license does not include any rights to resell, redistribute, reverse engineer, or create derivative works from our services.
User Content

- Warranties of merchantability and fitness for a particular purpose
- Warranties of non-infringement or title
- Warranties regarding accuracy, reliability, or availability
- Warranties that services will be uninterrupted, timely, or error-free
- Warranties regarding the results obtained from using our services
- Warranties regarding security or freedom from viruses or harmful components
No advice or information, whether oral or written, obtained from GoToProxy or through our services shall create any warranty not expressly stated in these Terms.
10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOTOPROXY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Business interruption or loss of goodwill
- Cost of procurement of substitute services
- Unauthorized access to or alteration of your transmissions or data
- Statements or conduct of any third party using the services
- Any other matter relating to the services or these Terms
AGGREGATE LIABILITY CAP: In no event shall our total aggregate liability to you for all damages, losses, and causes of action exceed the amount paid by you to GoToProxy in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
These limitations apply regardless of the legal theory upon which the claim is based (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
11. Indemnification
You agree to defend, indemnify, and hold harmless GoToProxy Technologies Inc., its affiliates, licensors, service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your violation of these Terms; (b) your use or misuse of the services; (c) your violation of any third-party rights, including intellectual property rights or privacy rights; (d) any content you submit, post, or transmit through the services; or (e) your violation of any applicable laws or regulations.
12. Dispute Resolution & Arbitration

Informal Dispute Resolution
Before initiating arbitration or legal proceedings, you agree to first contact us at contact@gotoproxy.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute through good faith negotiations for at least 30 days.
Arbitration Clause
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in San Francisco, California, under the Commercial Arbitration Rules of the American Arbitration Association (AAA). The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver
YOU AND GOTOPROXY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. You agree to waive any right to participate in a class action or class-wide arbitration.
13. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. You agree that any legal action or proceeding between you and GoToProxy for any purpose concerning these Terms or the parties’ obligations hereunder shall be brought exclusively in the federal or state courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.
14. Modifications to Terms
GoToProxy reserves the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of material changes by posting the updated Terms on our website with a new “Last Updated” date and, for registered users, by sending an email notification to your registered email address at least 30 days before the effective date. Your continued use of the services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must discontinue use of the services and may terminate your account.
15. Termination
Your Right to Terminate
You may terminate your account at any time by contacting customer support at contact@gotoproxy.com or through your account dashboard. Upon termination, you will lose access to all services, and no refunds will be provided for unused portions of prepaid services except as required by law.
Our Right to Terminate
We may suspend or terminate your account and access to services immediately, without prior notice or liability, for any reason, including breach of these Terms, fraudulent activity, abuse of services, non-payment, or upon your request. Termination does not relieve you of obligations to pay outstanding fees.
Effect of Termination
Upon termination, all rights granted to you will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.
16. Miscellaneous Provisions
Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and GoToProxy concerning the services.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and GoToProxy’s failure to assert any right or provision under these Terms shall not constitute a waiver.
Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. GoToProxy may assign its rights and obligations without restriction.
Force Majeure
GoToProxy shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including acts of God, war, terrorism, riots, natural disasters, or government actions.
Language
These Terms are provided in English. Any translations are provided for convenience only. In case of any conflict, the English version shall prevail.
